Extra Credit

In our chapter about the Need for Water in Ancient Times, document 8 are sections from the Code of Hammurabi.

In that document it says, "If a man neglects to maintain his dike and does not strengthen it, and a break s made in his dike and the water carries away the farmland, the man in whose dike the break has been made shall replace the grain which has been damaged."

What if the man in question was renting the land from a landlord?  Who is responsible to maintain the dike?  The farmer renting the land or the landlord?

  1. "Landowners frequently cultivated their land themselves, but could also employ a husbandman, or rent it. The husbandman was bound to carry out proper cultivation, raise an average crop, and leave the field in good tilth. In case the crop failed, the Code fixed a statutory return."

    This says that if the land is being farmed by a husbandman then the land lord is responsible for the land.

    "Land might be leased at a fixed rent, where the Code stipulates that accidental loss fell on the tenant."

    This is saying, if the land is rented for a fixed amount of money, then the tenant is responsible for the land.

    "If leased on profit-sharing terms, the landlord and tenant shared the loss proportionally to their stipulated share of profit."

    This says that if the land lord and the tenant are doing a profit sharing contract, then they are both responsible.

  2. the man that was renting the land most likely will not get penalized.the land lord is responsible to fix the damage of the land.but if someone stole something from someone, then he will have to pay for every thing he has stolen. but if you damage something, still some thing or attempt to still some thing you will have to pay. either if it was for food,your own goods, or repaying them in your grain. either way you will be penalized.

  3. Think about it as a house. If you are renting the house and the sink breaks then you have to tell your landlord and he is supposed to be responsible to fix what was broken. Same thing here, if the land is your home and something breaks, which is the dike, then the landlord is responsible for the dike. I know this because i know someone that owns houses and rents them so i know that that landlord is responsible for what breaks.

  4. If the man is renting the land from the landlord , then it is the landlord's job to replace the grain that's been damaged . That's because the land still belongs to the landlord and it is the landlord's job to be responsible for the land and what happens to it .
    It is the man's job to maintain the dike because in this case , the man is renting the land so he is at least responsible for maintaining the dike .

  5. In my opinion,i think that the person renting the dike should be penalized because the land owner was renting it to him. Therefore, It was his for that period of time & He did no take care of it.

  6. The man renting the land from his landlord is responsible to maintain the dike. My reason is because the man neglected his dike, not the landlord. The landlord owns the land but the things on the land which points to the guilty defendant, the man. Why should the landlord pay for the loss of crops when it was the man's fault to fix the dike?

  7. in my opinion i think it is the landlord's responsibility to fixed the damaged land. even though the man is renting the land the land still belongs to the landlord, therefor he should be responsible for the damages.
    even though the landlord is responsible for maintaining the land it is the man's job who is renting the land to take care of the dike.

  8. i think the man who is renting the land from the landlord is responsible to maintain the dike.. it's because the men neglected his dike,and not the landlord.the landlord do own the lord but the dike is on the land which points out the reason. SO WHY BLAME THE LANDLORD WHEN THE GUY BROKE IT HIMSELF?! =)
